PURPOSE
Telemedicine involves the use of electronic communications to enable healthcare providers at different locations to share individual patient medical information for the purpose of improving patient care. Telemedicine services may include consultation, diagnosis, treatment, follow-up, and patient education using interactive audio, video, and/or data transmission.
NATURE OF TELEMEDICINE SERVICES
Telemedicine may involve the transmission of video and/or audio for live consultation, and the exchange of medical information, images, documents, and other data to assist in evaluation, diagnosis, and treatment.
BENEFITS
Potential benefits of telemedicine include improved access to care, convenience, reduced travel time, and timely clinical decision-making.
RISKS OF TELEMEDICINE
Telemedicine has potential risks, including interruptions, unauthorized access, technical difficulties, or limitations in assessment compared to an in-person examination. If the Provider determines that an in-person visit is required, you may be asked to attend a face-to-face appointment or seek urgent/emergency care.
CAYMAN ISLANDS DATA PROTECTION NOTICE (DPA 2017 REVISION)
This Telemedicine service involves the collection and processing of personal data, including sensitive personal data/health data, in accordance with the Data Protection Act (2017 Revision) of the Cayman Islands (“DPA”).
For the purposes of the DPA, the healthcare provider/practice is the Data Controller (the “Provider”) responsible for deciding how and why personal data is processed.
1. What data may be collected and used: identification details, contact details, medical history, diagnoses, medications, allergies, clinical notes, test results, telemedicine interaction details, and billing/payment information (where applicable).
2. Purposes of processing: providing medical care, maintaining medical records, prescriptions and referrals, communication regarding care, administration, compliance, quality assurance, billing and payment processing (where applicable), and meeting legal/regulatory obligations.
3. Lawful basis for processing: medical purposes, legitimate interests in providing safe and effective healthcare, legal obligations, and/or explicit consent (particularly for health data).
4. Confidentiality and security: the Provider will take reasonable technical and organisational measures to protect personal data; however, no system is entirely secure and there remains a risk of inadvertent disclosure or unauthorized access.
5. Sharing and disclosure: personal data may be shared as necessary with clinical/administrative staff, labs, pharmacies, specialists, hospitals, insurers/billing entities (where applicable), telemedicine service providers, and authorities where required by law.
6. International/overseas transfers: systems used may store/process data outside the Cayman Islands. Where transfers occur, the Provider will take reasonable steps to ensure appropriate safeguards consistent with the DPA.
7. Data retention: personal data will be retained only for as long as necessary for medical care, legal/regulatory compliance, and recordkeeping obligations.
8. Your rights under the DPA may include access, correction, objection in certain circumstances, restriction (where applicable), deletion where legally permitted, and withdrawal of consent where consent is the lawful basis.
9. Questions/complaints: you may contact the Provider with concerns. If you believe your rights under the DPA have not been respected, you may lodge a complaint with the Office of the Ombudsman (Cayman Islands).
PATIENT CONSENT
1. I understand the nature of telemedicine and agree to participate in telemedicine consultations as clinically appropriate.
2. I understand that telemedicine may involve the use of video/audio communications and the exchange of medical information electronically.
3. I understand that I may withdraw my consent for telemedicine at any time, and I may request an in-person visit where available.
4. I understand that reasonable efforts will be made to protect my privacy and personal data in accordance with the Cayman Islands Data Protection Act (2017 Revision), however there remains a risk of inadvertent disclosure due to technology or security failures.
5. I acknowledge that I have read and understood the Data Protection Notice above and I consent to the processing of my personal data, including health data, for the purposes described in this form, including the use of telemedicine systems that may involve processing outside the Cayman Islands.
